Our Terms


The following terms apply when submitting or contributing “User Generated Content” (UGC) (including reviews or posts) to The Kamugasa Challenge (TKC). By ‘UGC’ we mean a wide variety of media content that may be produced by our audience (including guest bloggers and guests on the podcast) as opposed to content produced at TKC.

Please take the time to read and understand them, because you should not use any of our website unless you agree to these terms.

 

1. What we will do for you: We will respect you and your privacy. We recognise the importance of privacy, so if you are using our website service under a pseudonym, we will keep your true identity secret unless we are legally obliged to reveal it. Please note that we may edit or delete the content you provide at any time at our sole discretion, although we have no obligation to review the information you provide.

 

2. What you should do for us: Please behave responsibly when adding content to our website. By using our website, you agree to the following:

You will not use our website in any way that is:

• illegal or unlawful, or likely to encourage illegal or unlawful behaviour;
• likely to damage the reputation of TKC;
• likely to be a nuisance, harmful or deceptive to any other person.

Any content you submit or add to the website will:

• be factually accurate and/ or be your genuinely held belief or opinion that is based on facts;
• not be defamatory, obscene or offensive;
• not infringe the copyright, trademarks or any other intellectual property rights of another person;
• not promote your own or your employer’s business or otherwise include any advertising or promotional material.

You will not access any confidential information (including usernames and passwords) of any other person.

You must be over 18 years old or otherwise have the express permission of your parent or guardian to use the website.

If your children use our website, please help us with their online safety by making sure they understand the potential risks of using the internet.

Please tell us as soon as you can if you think someone is misusing our website.

 

3. Other important things you must know: You take full responsibility for the content you submit or add to our website, which means that if you provide content in breach of these terms, you may be required to compensate anyone who suffers as a result.

You grant us a non-exclusive licence to use the content you submit or add to our website. This means that if you submit any content to or share any material with TKC (including any text, photographs, graphics, video or audio), you will retain the copyright in your work. As the non-exclusive licence to TKC is only a permission for us to use the content, you can also continue to use your content in any way you wish, including using it yourself and/or allowing others to use it.

Please note that in the majority of instances, TKC does not amend, edit or alter any material submitted for publication on our website. But due to technical or operational limitations, TKC may have to slightly amend content such as cropping images to be able to use them. We endeavour not to make any significant editorial amendments to your work without your consent.

We may need to contact you to authenticate or verify your content and/ or obtain further information about your work. If we are unable to contact you we may be unable to use your content for the particular purpose for which it was submitted. If, for whatever reason, we cannot accept your content or have to reject it if it breaches the terms and conditions, we will endeavour to let you know.

Please be advised that we do not pay for any user-generated content except in very exceptional circumstances.

 

4. What happens if you don’t comply with these terms? We will treat any non-compliance as a serious issue, and if we think you have breached any of these terms, we may take any action that we consider appropriate. This may include:

• the temporary or permanent suspension of your access to our website;
• taking legal action against you, possibly to recover any financial loss that we have suffered as a result of your actions; or
• publishing a statement on our website detailing your actions.


Privacy Policy

This is the main privacy policy for The Kamugasa Challenge (TKC).

At TKC we collect different types of information about our users for four main reasons:

  1. To provide personalised services unique to individual users.
  2. To help us to monitor and improve the services we offer.
  3. If we have permission from the user, or where otherwise allowed by law, to market services to them.

Our principles

  1. We do our very best to protect your privacy by using security technology appropriately.

This means:

  • we make sure that we have appropriate security measures to protect your information; and
  • we make sure that when we ask another organisation to provide a service for us, they have appropriate security measures.
  1. We will respect your privacy. You should receive marketing/promotional (whether by email, post, SMS or telephone) only from us and, if you agree, from other organisations we have carefully chosen. We will make sure it is clear when you can make these choices, for example, we have boxes you need to tick if you want to receive marketing/promotional and you can change your preferences if you no longer want to receive it. However, we may email you occasionally with information or questions about your registration or postings, for example, with reminders, warnings or copyright requests.
  2. We will collect and use individual user details only if we have your permission or we have sensible business reasons for doing so, such as collecting enough information to manage subscriptions.
  3. We will be clear in our dealings with you as to what information about you we will collect and how we will use it.
  4. We will use personal information only for the purposes for which it was originally collected and we will make sure we delete it securely.
  5. Our site is accessible via the internet. This means that people around the world who access our website can see anything you post on the website, for example, comments about a blog. Please note that we do not allow comments on this site presently, but may allow them in the future.
  6. If we or our service providers transfer any information out of the European Economic Area (EEA), it will only be done with the relevant protection (stated under UK law) being in place.

How we use your information, and what information do we collect?

We collect information on you:

  • when you subscribe to The Kamugasa Challenge Newsletter
  • when you use the website
  • through cookies, and
  • if you choose to reveal information in postings, that is, if and when comments are enabled.

Certain services that we provide may involve us collecting extra information (e.g. donations in support of TKC), such as where you are, so the service can be provided as designed.

Subscription to the Newsletter

The minimum information we need to subscribe you is your name, and email address. We may ask you more questions for different services, including promotions of say, a book(s). Unless we say otherwise, you have to answer all the questions when subscribing to the Newsletter.

After you have subscribed to our Newsletter, and with your permission, we may send you emails we think may interest you. Newsletters may be personalised based on what you have been reading on thekamugasachallenge.com. At any time you can decide not to receive these emails and will be able to ‘unsubscribe’.

Use of children’s data

We do not knowingly collect or store any personal information about children under the age of 16 and we do not offer any of our products or services directly to children under the age of 13.

Who we share data with

We will not share your personal information with others for marketing/promotional purposes unless you have given us your permission. If we have your permission, we will share your information only with other organisations we have chosen carefully.

We can access and release personal information to keep to relevant laws and government requests, to operate our systems properly and to protect both us and our users.

Any other organisations that access your information in the course of providing services on our behalf will be governed by strict contractual restrictions to make sure that they protect your information and keep to data-protection and privacy laws which apply. We may also independently audit these service providers to make sure that they meet our standards. We may use service providers to help us run our site (or services available on the sites), some of whom may be based outside the EEA.

Some of our webpages use plug-ins from other organisations (for example Twitter or LinkedIn). These other organisations may use information about your visit to our website on their pages. For more information on how these organisations use information, please read their privacy policies.

Use of Cookies

Cookies are small text files that are stored by the browser (for example, Internet Explorer or Safari) on your computer or mobile phone. They allow websites to store things like user preferences. You can think of cookies as providing a ‘memory’ for the website, so that it can recognise you when you come back and respond appropriately.

We use cookies for a number of reasons.

  1. For statistical purposes to track how many users we have and how often they visit our website. We collect information listing which of our pages are most frequently visited, and by which types of users and from which countries.
  2. We use other organisations to collect anonymous user information, sometimes through cookies and web beacons, (information embedded in images which allow them to analyse how the website is being used and the number of visitors).
  3. Placing cookies on your computer means we can show you pages that you might be interested in, and allows us to control the number of times you see them and measure how effective particular pages have been.
  4. We may use ‘Flash’ cookies to store your preferences for your media player (for example, volume and so on). If we don’t use them, you may not be able to watch some video content.
  5. You can turn cookies off but if you do this, you may not be able to use all services on our website. This is because we won’t be able to limit what you see by using cookies. However, you will still be able to see our content.

Legal information and how to contact us

Under the UK Data Protection Act 1998 we have to say who the ‘data controller’ is for thekamugasachallenge.com. The data controller is the proprietor responsible for protecting information and, in our case, is Stephen Kamugasa.

If you would like access to or a copy of the personal information we hold about you, to request a correction, or have any questions about how we may use it or to make a complaint, please contact Stephen Kamugasa Challenge directly using our Contact Form on the website.

Complaints will be dealt with by the Data Protection Manager, and will be responded to within 30 days at the latest.

If you are not satisfied with the way your complaint was handled, you may
be able to refer your complaint to your local data protection regulator. For example, in the United Kingdom this is the Information Commissioner’s Office.

Changes to the privacy policy

Should we elect to change our privacy policy we will post the changes here. Where the changes are significant, we may also choose to email all our subscribers and supporters with the new details. Where required by law, will we obtain your consent to make these changes.
